Section 1: Website, Products, and Use of Squarespace Services

1.2 Products for Sale
All products listed for purchase on our website are subject to availability. Prices and product details are subject to change without notice. We do not offer refunds for changes of mind. Refunds or exchanges for faulty products will be handled in accordance with Australian consumer law.
1.3 Use of Squarespace Services
Our website is hosted on Squarespace. By accessing or using our website, you agree to be bound by the Squarespace Terms of Service, which can be found at www.squarespace.com/terms.
1.4 Account Creation
In order to make purchases or access certain features, you may be required to create an account on our Squarespace website. You agree to provide accurate and complete information when creating your account and to maintain the confidentiality of your login credentials.
1.5 Limitations of Liability
We are not responsible for any issues that may arise from the use of Squarespace, including downtime, technical issues, or interruptions in service. For support related to Squarespace services, you must contact their support team directly.
1.6 Content Ownership
All content on the website, including text, images, and design, is owned by or licensed to Florin and Grace, unless stated otherwise. Squarespace's platform may host and store this content, but you retain ownership of your submitted content, subject to the licensing granted to us for display on the website.
1.7 Modifications and Termination
Squarespace reserves the right to modify, suspend, or discontinue any aspect of their service at any time. We will not be held responsible for any such changes or disruptions that impact the availability of our website or services.

2.1 Pricing Changes
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue products at any time without prior notice. Any changes to pricing will be reflected on the website immediately.
2.2 Billing Accuracy
You agree to provide accurate, complete, and current information for all purchases made through our website, including your name, email address, billing address, and payment details. You agree to promptly update your account and payment information to keep it accurate. We are not responsible for any errors or issues that arise due to incorrect or outdated billing details.

Section 3: Personal Information and Governing Law
3.1 Personal Information
We collect personal information when you use our website, including but not limited to your name, email address, shipping address, and payment details. This information is used to process transactions, improve our services, and communicate with you regarding your orders.
3.2 Privacy Practices
Your privacy is important to us. We will not sell, rent, or lease your personal information to third parties. We may share personal information only with trusted third-party service providers necessary to complete transactions, such as payment processors and shipping companies.
3.3 Data Security
We implement reasonable security measures to protect your personal information. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee the absolute security of your data.
3.4 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Australia. Any disputes related to the use of the website or the products sold shall be resolved in the courts of Australia, and you consent to the exclusive jurisdiction of these courts.
3.5 Dispute Resolution
In the event of a dispute, we encourage you to contact us first to seek a resolution. If the issue cannot be resolved through direct communication, both parties agree to pursue alternative dispute resolution methods, such as mediation or arbitration, before seeking legal action
Section 4: Rental Products
4.1 Rental Items
We offer a wide range of event props for hire, including but not limited to plinths, easels, and backdrop setups.
Rental items remain the property of Florin and Grace at all times.
4.2 Rental Period
The standard rental period is 24 hours unless a longer period is agreed upon in writing.
Late returns will incur a fee of $50 per day.
4.3 Delivery and Pickup
As stated in the Florin and Grace Booking Form, the Owner is responsible for delivering the equipment to the hirer's venue. Pickup is also available at the hirer's risk, unless otherwise stated or quoted.
If there are significant changes to the documented plan during setup, an additional fee may be charged based on the extent of the changes and their impact on staffing.
Should the hirer be required to pay this additional fee, it will be deducted from the security bond. If the security bond is insufficient to cover these charges, the hirer will need to provide further payment via the credit card on file.
Please ensure to carefully review the details in the Florin and Grace Booking Form and coordinate with the Owner to avoid any unexpected costs.
4.4 Pricing and Payment
Currency: Payment for services and/or products will be made in Australian Dollars (AUD).
Payment Methods: Payments can be made via Electronic Funds Transfer (EFT) or Direct Deposit.
Hire Retainer Fee: To secure your booking, a non-refundable 50% retainer fee of the overall service fee is required.
Full Payment: Full payment must be made 7 days prior to the event.
Refundable Bond: A refundable bond fee is required as part of the hiring process. This is payable in cash. This ensures our hired items are not damaged or missing after the event.
Bond Refund: Florin and Grace will refund the bond to customers on return after assessing the props and items for damages.
Booking Confirmation: Bookings are only confirmed once payment has been received by Florin and Grace, and a payment invoice has been provided. An Hire Booking form must be completed within 7 days before the event start date. The event date can only be rescheduled with a minimum of 7 days' notice. We will attempt to reschedule based on availability, but cannot guarantee that a future date will be available. If rescheduling is not possible, we will refund 50% of the total service price (if fully paid), with the other 50% being non-refundable (please refer to point number 3 in this paragraph).
Price Changes: All prices displayed on our website or via written agreement are subject to change without notice.
Item Inspection and Damages: Hired items will be inspected upon return. Any damage or breakage will be deducted from the bond. If the damaged items are beyond repair, Florin and Grace reserves the right to bill the client for the equivalent market value.
Quote Validity: The price on any quote or tax invoice issued by Florin and Grace to the hirer is only valid for 7 days from the date of issuance. Prices may differ if a new quote/tax invoice is generated for the hirer after this period.
4.5 Cancellations and Refunds
We do not offer refunds for changes of mind.
Cancellations or refunds will be considered on a case-by-case basis and are subject to our discretion.
Cancellation of Setups: The Hirer has the option to cancel a setup booking, but any fees paid shall be forfeited according to the following terms:
The 50% non-refundable retainer fee cannot be refunded under any circumstances.
If a refund is approved, it will be provided within 10 business days via Electronic Funds Transfer (EFT).
Bookings cancelled by the Hirer in writing less than two weeks before the setup date will result in a 50% forfeiture of the total hire fee.
Any adjustments or cancellations of setup items must be made 2 weeks prior to the event/setup date. Fees apply for changes or cancellations outside of this timeframe.
If you choose to postpone, we require two weeks' notice, and this will be subject to our availability. The new booking date must be scheduled within 6 months of the original booking date. No credit will be offered after this timeframe, and any monies paid will be forfeited.
4.6 Weather Conditions - Set Up
The Hirer acknowledges that all hired items may not be suitable for adverse weather conditions and understands that Florin and Grace reserves the right to refuse the use of items in specific areas if deemed unsafe.
In the event of rain during outdoor use, the Hirer must promptly relocate all hired items indoors or under cover.
If items are returned damp and require drying to prevent damage such as mold, additional fees may be incurred.
The Hirer is responsible for having an alternative plan (Plan B) in case of unfavorable weather conditions, including windy conditions.
Should the Hirer wish to postpone the event due to weather concerns, a 2-day notice is required. Florin and Grace will accommodate rescheduling, subject to availability, within a one-month timeframe.
Failure to reschedule within this period will result in the cancellation of the booking.
If the Hirer requests a cancellation due to weather conditions, the same cancellation conditions will apply as listed above.
4.7 Damage and Liability
Customers are responsible for the proper use and care of all hired items.
Any damages, breakages, or loss of items during the rental period will result in deductions from the security bond or additional charges.
4.8 Client Responsibilities
Customers must:
Ensure the hired items are kept in a safe and secure location.
Use hired items only for their intended purposes.
Return all items in the same condition they were received.
Inform Florin and Grace immediately in case of any issues with the rented items.
4.9 Liability Waiver
Florin and Grace is not responsible for any injuries, damages, or losses caused by the use of rented items.
Customers accept full responsibility for ensuring the safe use of all rental items.
Section 5: Agreement Terms
5.1 Termination
These Terms of Service are effective unless and until terminated by either you or us.
You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services, or by ceasing to use our website.
If, in our sole judgment, you fail or we suspect that you have failed to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and/or we may deny you access to our services.
5.2 Survival of Obligations
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
